Please read the following terms and conditions of sale carefully before ordering
products from us. By purchasing goods from us, you agree to these terms of sale.
These terms and conditions are not intended to replace your statuary rights, and
do not affect your statuary rights. In these terms the words "you" and "your" refer to
the customer and "us" "our" and "we" refer to Image Audio the company which
runs www.ps3offer.co.uk.
1. Order acceptance
(a) A contract for the sale of product (s) is created when you pay for your
item via paypal
(b) All orders are subject to availability
(c)We will not be legally bound by any errors on our website, wether
they are typographical or factual
2. Delivery And Price
(a) The price you will pay for your goods is the price you will be told in
the email confimation from paypal, this will not differ from the website, if
a clerical error is made in pricing and it differs from the website price
we reserve the right to cancel the contract and give you your money
back, also if you are charged more than the advertised price due to an
error you can cancel your contract and are entitled to a full refund.
(b) You will be given an estimated time for delivery via email after your
order, although most deliveries are sent next day if ordered before
12.00pm we can not guarantee this, also we will not be held
responsible for couriers errors and mistakes, and will not compensate
you in any way for this. It is your responsibility to check the parcel when
delivered and sign that it has been delivered in a satisfactory condition.
If the parcel looks damaged then reject it and we will send you a new
one.
(c) Once you have signed for the goods they become your responsibity
and we won't be held responsible for loss or breakages.
(d) If you no longer require the goods you may return them to us within
14 days from date of dispatch, in their original unopened condition, with
all accessories in place, we reserve the right to charge a 25%
restocking fee for this service.
(e) If you return the goods and they have been damaged while in your
care then we will send the goods back to you and charge you for the
re-delivery of the goods.

To fullest extent permitted at law and except in respect of death and
personal injury caused by negligence on our part or on the part of our
employees we shall not be liable to you by reason of any
representation (unless fraudulent), or any implied warranty condition or

contract for any indirect, special or consequential loss or damage
(whether for loss of profit or otherwise), costs, expenses or other
claims for compensation whatsoever (whether caused by negligence
on our part or the part of our employees or agents or otherwise) which
arise from or in connection with the use of the website, the supply of
goods or their use or resale by you, and our entire liability under or in
connection with the contract shall not exceed the price of the goods,
except expressly provided in these conditions. This does not affect your
statutory rights.
5. Force Majeure
No Party shall be liable for any failure to perform its obligations where
such failure is as a result of Acts of Nature (including fire, flood,
earthquake, storm, hurricane or other natural disaster), war, invasion,
act of foreign enemies, hostilities (whether war is declared or not), civil
war, rebellion, revolution, insurrection, military or usurped power or
confiscation, terrorist activities, nationalisation, government sanction,
blockage, embargo, labour dispute, strike, lockout or interruption or
failure of electricity [or telephone service], and no other Party will have a
right to terminate this Agreement under Clause 19 (Termination) in
such circumstances.
6. Invalidity
In the event that any clause in this contract is deemed to be
unenforceable, the enforceability of any other part of these conditions
will not be affected.
7. Governing Law and Jurisdiction
This Agreement will be governed by and construed in accordance with
English Law.
